White Hall case goes to circuit court

FAIRMONT — The  town clerk charged with embezzling more than $10,000 from White Hall has waived her right to a preliminary hearing in Marion County Magistrate Court.

Madeline Martin, 70, had been arrested July 17 by West Virginia State Police and charged with embezzling more than $10,000 over the past few years from municipal and general funds.

By waiving the preliminary hearing, a defendant is not admitting guilt but is agreeing there is enough evidence against him or her to stand trial.

“Her file goes to circuit court,” said assistant prosecutor Dana R. Shay. “The next stage, if it proceeds that far, is a grand jury indictment.”

The next term for grand jury is Oct. 1-3, with the docket call released on Oct. 5.
