Preliminary hearing reset for local man accused of stabbing

FAIRMONT — A preliminary hearing set Wednesday for a man who allegedly stabbed another man at a Fairmont gym last week will be reset in Marion County Magistrate Court once he obtains legal counsel.

Fairmont resident Thomas Edward Smith, 58, told Magistrate Hank Middlemas that he could not find an attorney in time for the Wednesday afternoon hearing, which had to be scheduled within 10 days of his arrest and arraignment last week.

Smith said he “does not know a criminal attorney in Marion County,” which is why he was unable to obtain counsel in time for this hearing.

Smith was charged with malicious wounding after he allegedly stabbed David McRobie in the parking lot of Fairmont Fitness at around 8:30 a.m. last Friday.

    A Fairmont man has been indicted by the Office of the United States Attorney Northern District of West Virginia on a child pornography charge.
    Clyde Bates, 67, was named in a one-count indictment charging him with possession of child pornography in Fairmont on Aug. 27, 2010.
