Marion County hands down 36 indictments on second day

FAIRMONT — The Marion County Grand Jury handed down indictments on 36 individuals during its second day of testimony Tuesday.

The indictments covered everything from DUI to domestic abuse.

Those indicted included Charles Bonner Jr. and Josephine Lynn Goodnight, who were both charged with child neglect resulting in injury and child neglect creating risk of injury.

In April, the two were arrested by the West Virginia State Police after that agency learned they had allegedly been neglecting their 5-month-old son and 2 1/2-year-old daughter. Goodnight allegedly admitted that while she had a medical card, she had not taken either child to the doctor. Both Goodnight and Bonner allegedly admitted using drugs. The children were placed in the care of Child Protective Services.

James D. Swiger II, 41, was also indicted. He is accused of sexually molesting at least two of his children, a 14-year-old girl and 12-year-old boy, and physically abusing his family.

Those who have been indicted have not been convicted of a crime.

Presentations before the grand jury will continue today, Marion County Prosecuting Attorney Pat Wilson said.

Those indicted by the Marion County Grand Jury on Tuesday were:

• Robert Issac Snell, 28, of 1311 Anderson Court, Fairmont, three counts of possession of a controlled substance with intent to deliver.

• Desirea Jean Santiago, 31, of 511 Rose Ave., Fairmont, 11 counts of burglary; two counts of fraudulent use of an access device.

• Bethanie L. Carpenter, 24, of Unity Terrace Apt. 9-E, Fairmont, child abuse resulting in injury.

• David Lee Martin, 33, of 512 1/2 E. Park Ave., Fairmont, delivery of a controlled substance.

• Jason Abner Moyer, 43, of 649 Sassafras Drive, Fairmont, possession of a controlled substance with intent to deliver; manufacturing a controlled substance.

• Matthew Lemley, 38, of P.O. Box 63, Worthington, fleeing in a vehicle while DUI, controlled substance or drugs at the time; fleeing from an officer by means other than use of a vehicle; first-offense DUI.

• Nathan Crandall, 28, of Route 3 Box 228-D, Bridgeport, conspiracy to commit a felony.

• Heather Parker, 36, of 196 Sixth St., Carolina, child neglect creating risk of injury.

• Roger Jones, 44, of 908 Cleveland Ave., Fairmont, six counts of delivery of a controlled substance; transferring and receiving stolen goods.

• Antonio Devon Cottingham, 25, of 618 Market St., Fairmont, conspiracy to commit a felony; delivery of a controlled substance.

• Eric Scott Everhart Sr., 48, of 207 Lakeview Drive, Morgantown, delivery of a controlled substance; conspiracy to commit a felony; possession of a controlled substance with intent to deliver.

• Robert Brian Pitzer, 40, of 480 Leonard Ave. Ext., Apt. 4-C, Fairmont, delivery of a controlled substance; conspiracy to commit a felony.

• Sonya Jo Pitzer, 40, of 480 Leonard Ave. Ext., Apt. 4-C, Fairmont, delivery of a controlled substance; conspiracy to commit a felony.

• Johnnie Lee Alston Jr., 30, of 1572 A Red Oak St., Charleston, possession of a controlled substance with intent to deliver.

• Sarah Carpenter, 26, of Route 2 Box 12B, Rivesville, child neglect creating risk of injury.

• Michael David Handley, 49, of 411 Jefferson St., Mannington, fraudulent use of an access device; forgery; uttering; conspiracy to commit a felony.

• Cleive Junior Miller, 50, of 219 Maple Ave., Fairmont, delivery of a controlled substance.

• Dustin Keith Sine, 24, of 480 Leonard Ave., Apt. 5-C, Fairmont, fraudulent use of an access device.

• Robert C. Miller II, 39, of 608 Hoglick Hollow, Fairmont, first-degree sexual abuse.

• Eric Scott Everhart Jr., 25, of 1561 Mary Lou Retton Drive, Fairmont, delivery of a controlled substance; conspiracy to commit a felony.

• Charles Bonner Jr., 30, of Route 4 Box 101, Fairmont, child neglect resulting in injury; child neglect creating risk of injury.

• Josephine Lynn Goodnight, 32, of 1105 Carlton St., Fairmont, child neglect resulting in injury; child neglect creating risk of injury.

• Robert Edward Bowman, 39, of 896 Mods Run Road, Mannington, two counts of third or subsequent offense DUI; two counts of driving on a license suspended or revoked for DUI.

• James D. Swiger Jr., 41, of 127 Church St., Grant Town, child abuse resulting in risk of injury; sexual abuse by a parent, guardian or custodian; second-offense sexual assault.

• William Joseph Proctor Sr., 59, of 320 Walnut Ave., Apt. 3, Fairmont, child abuse resulting in injury; child neglect creating risk of injury or death; three counts of possession of a controlled substance with intent to deliver.

• Tyler Ray Efaw, 26, of 939 Earl Drive, Fairmont, unlawful assault.

• Lucas Matthew Mayle, 27, of Route 1 Box 134, Shinnston, possession of a controlled substance with intent to deliver.

• Kenneth Wayne Neel, 33, of Route 4 Box 585-A, Fairmont, malicious assault.

• Timothy Wade Biggs, 31, of 530 Walnut Ave., Fairmont, unlawful wounding; two counts of possession of a controlled substance with intent to deliver.

• Leah Marie Wiant (age unavailable), of 101 Williams St., Fairview, possession with intent to deliver; conspiracy to commit a felony.

• Andrew Jackson Wiant (age unavailable), of 1010 Ridgeley Ave., Fairmont, possession with intent to deliver; conspiracy to commit a felony.

• Michael James Farley, 30, of 413 McLane Ave., Apt. 1, Morgantown, fleeing.

• David Lee Martin, 33, of 512 1/2 E. Park Ave., Fairmont, delivery of a controlled substance; first-degree robbery; conspiracy to commit a felony.

• Amber Eve, 23, of 1211 Country Club Road, Fairmont, first-degree robbery; conspiracy to commit a felony.

• David Kyle Brown, 19, of Route 2 Box 322, Clarksburg, first-degree sexual assault; sexual assault by a parent, guardian or custodian.

• Denford Mcie, 37, of 2373 Miller Ave., Fairmont, kidnapping; third-offense domestic battery.
