County BOEs file suit against state

Marion County one of 50 seeking answers to OPEB

FAIRMONT — Fifty of the state’s 55 county boards of education filed suit against the state Monday.

The Marion County Board of Education is one of those 50 BOEs.

“This morning 50 county boards of education filed a lawsuit against the Public Employees Insurance Agency, the Public Employees Insurance Agency Finance Board, and the West Virginia State Auditor in the Circuit Court of Kanawha County,” Charleston attorney Howard Seufer, who is representing the boards of education, stated via e-mail Monday.

All the fuss is over Other Employment Benefits (OPEB) that are paid to retirees after their retire date and who is responsible for paying for those benefits. Thanks to a new accounting policy adopted by the federal Governmental Accounting Standards Board a few years ago, governments must show what they’ll have to pay for retirees’ benefits as a liability before the employees retire.
