State hears arguments in Taylor case

Justices expected to make decision within 90 days

FAIRMONT — The fate of a high-profile local murder suspect is now in the hands of five state judges.

Wednesday, a panel of four state Supreme Court of Appeals justices and one substitute judge in Charleston heard arguments in the case of Lincoln Taylor.

Taylor, a 26-year-old Huttonsville native, stands accused of first-degree murder for serving as the alleged triggerman in the fatal Memorial Day 2007 shooting of 22-year-old South Carolina native Derrick “Lil’ D” Osborne in a Bellview neighborhood.

Taylor has been tried twice in Marion County Circuit Court, the first trial ending after four days because of jury misconduct and the second resulting in an acquittal on a charge of conspiracy and a hung jury on the first-degree murder charge.

    A Fairmont man has been indicted by the Office of the United States Attorney Northern District of West Virginia on a child pornography charge.
    Clyde Bates, 67, was named in a one-count indictment charging him with possession of child pornography in Fairmont on Aug. 27, 2010.
